1. Who provides OwnMetric

OwnMetric is provided by BPS Designs Limited, a company registered in England and Wales under company number 05360014, with its registered office at 2a Swordfish Business Park, Swordfish Close, Higgins Lane, Burscough, Lancashire L40 8JW, United Kingdom. 2. Eligibility and accepting these terms

OwnMetric is intended only for people aged 18 or over. By creating an account or using the service, you confirm that you are at least 18, that the information you provide is accurate, and that you agree to these terms. If you do not agree, do not use OwnMetric.

3. Your account

You are responsible for keeping your device and sign-in credentials secure and for activity carried out through your account. Tell us promptly if you believe your account has been accessed without permission. You must not transfer, sell or share access to your account.

4. What OwnMetric provides

OwnMetric helps you record workouts, nutrition, body metrics and optional health activity; view trends; and use optional estimation and planning tools. Some features require compatible hardware, Apple Health permissions, network access, an App Store account or a paid subscription.

We may improve, replace or withdraw features when reasonably necessary, including for safety, legal, security or technical reasons. We will not materially reduce a paid service during its current subscription period without a valid reason and appropriate notice or remedy.

5. Health, nutrition and AI information

Calorie, macro, meal-photo, nutrition-label, suitable-meal, training and recovery outputs are estimates or general information. Sensors, databases, labels and AI can be incomplete or wrong. You must review information before relying on or saving it and use your own judgement about exercise selection, loads, food, allergies and health decisions.

Stop exercising and seek appropriate help if you feel unwell or believe you may have a medical emergency. Ask a qualified professional before changing exercise or diet where you have an injury, condition, symptom, pregnancy, medication concern or other clinical need. OwnMetric cannot verify that a food is safe for an allergy or intolerance.

6. Subscriptions, renewal and cancellation

OwnMetric may offer monthly and annual auto-renewable Premium subscriptions. The price and billing period shown in the App Store at purchase are the terms of your order and may vary by country or tax. Payment is charged to your Apple ID by Apple when you confirm purchase.

Unless you cancel at least 24 hours before the current period ends, your subscription renews automatically and Apple charges the renewal price. You can manage or cancel it in your App Store subscription settings. Deleting the app or your OwnMetric account does not itself cancel an App Store subscription. Refund requests and billing disputes are handled by Apple under its applicable rules and your statutory rights.

If a price changes, Apple will provide the notice or request the consent required by its rules. Cancellation stops future renewal; Premium access normally continues until the paid period ends.

7. Your content and licence to operate the service

You keep ownership of the workout, food, image and other content you submit. You give BPS Designs Limited a limited, non-exclusive licence to host, copy, process, transmit and display that content only as needed to provide, secure and improve the service you request and to comply with law. This licence ends when the content is deleted, except for lawful backups, unresolved disputes and anonymised information.

You must have the right to submit your content. Do not upload another person’s private information, unlawful material or content that infringes intellectual-property rights.

8. Acceptable use

You must not:

• break the law, harm others or misuse another person’s account or data;
• probe, bypass or interfere with security, access controls, limits or app attestation;
• introduce malware, overload the service, automate abusive requests or scrape protected content;
• reverse engineer the service except where applicable law expressly allows it; or
• use OwnMetric or its outputs to build a competing dataset, service or model without our permission.

We may restrict or suspend access where reasonably necessary to protect users or the service, investigate misuse, comply with law or address a serious breach. Where practical, we will explain the reason and allow a reasonable opportunity to resolve it.

9. Our intellectual property

OwnMetric’s software, design, branding and original content belong to BPS Designs Limited or its licensors. These terms give you a personal, limited, non-transferable, revocable right to use the service for its intended purpose; they do not transfer our intellectual property to you.

10. Availability and third-party services

We aim to provide a reliable service but cannot promise uninterrupted, error-free or permanently available access. Apple, Apple Health, Firebase, RevenueCat, OpenAI and network services are operated by third parties and may affect availability or particular features. We are not responsible for third-party services outside our reasonable control, but this does not affect any responsibility we cannot lawfully exclude.

11. Our responsibility to you

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects your mandatory rights under UK consumer law, including rights relating to digital content and services.

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business loss arising from consumer use, or for loss caused by inaccurate user input, disregarding a clear warning, or events outside our reasonable control.

12. Ending use

You may stop using OwnMetric at any time. To request account deletion, email us from your account address until self-service deletion is available. Remember to cancel any App Store subscription separately. Terms that by their nature should continue—including ownership, liability and dispute provisions—remain in effect after use ends.

13. Changes to these terms

We may update these terms to reflect service, legal or security changes. We will post the updated date and give reasonable advance notice of a material change where required. If you do not accept a material change, you may stop using the service and cancel your subscription before it takes effect.

14. Law and disputes

These terms are governed by English law. If you live in England or Wales, the courts of England and Wales have non-exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring a claim in the courts where you live. If you live elsewhere, you keep any mandatory consumer protections and rights to bring proceedings that apply in your home country.

Please contact us first so we can try to resolve a concern informally. These terms are between you and BPS Designs Limited; no other person has a right to enforce them except where law provides otherwise.

15. Apple terms

For an iOS download, Apple’s Standard Licensed Application End User Licence Agreement also applies. If these terms conflict with mandatory Apple terms, the mandatory Apple terms apply to that extent.
